Problem Solved

Especially, that their products do not really compete (with the exception of Hyperion 40.72 version of OS 3.1):
- Cloanto AmigaForever is a package you install on a Windows machine and can run AmigaOS, it provides all the ROMs and OS versions Cloanto is able to provide, very little is spent on developing the OS itself; only small but important patches are applied; just a few clicks and you have Amiga on your Windows PC - Hyperion team wants to develop OS 3 further, to fix bugs, annoyances, and to add new features, OS 3.1.4 is geared towards advanced Amiga user, who might want to combine it with OS 3.9, who might want to use symlinks and new shell features in the scripts they write, etc. And many Amiga users will want to have BOTH packages (unless they prefer to use pirated software, of course). So - why to fight? |

I suspect one of two things has happened..
1. Either they've been hit with a copyright claim as some people suggest (not sure i buy this) 2. The Amiga dealers have said they'd only carry the chips/disks in stock if Hyperion stopped the digital download option (or some variation of this theme). I think 2 is more likely. But there may be a third option i'm missing. You can definitely buy other things on their site. |

Hyperion promised they would do some things, and that they would not do other things. They've been caught doing the opposite of those things, so they've palmed some of their things off on other people in order to avoid having to explain to some very scary people what they have and have not been doing.
Time will tell whether that strategy is successful or not. |

Hyperion, Cloanto and Amiga Inc. are in court about AmigaOS 3.1.4 among others. 3.1.4 is explicitly mentioned as infringing copyrights and the infamous "Settlement Agreement" in the linked documents. So there is little room for your doubt. Of course, you would have to make the effort and read it yourself...
