I think Apple would let it pass, I know there are a few games that push the boundaries available for it.
Android will certainly allow it, theres several Minecraft clones on Android, some with names almost exactly the same, and they don't get pulled.
Of course if the original developers complained to either, I'm pretty sure they'd pull your app from the market.
