Copyrights should be protected and enforced by their holders, which, for example, Nintendo does all the time.
If a copyrighted work is not actively protected for a long time (which is the case with OS3.9), I will happily download it without feeling any remorse.
Regarding CoffinOS, it is not sold, but freely distributed via torrent.
