hi...
Hello,
Im new one here and I have some questions.Are the Cd32 isos illegal? 5 hours ago I sent a pm to 2 opers but no one answered(this is rude btw...I asked for this info very polite).I have a bunch of Cd32 uploads in Megaupload and it will be my pleasure to share them with amiga fans. I do not sell links! I just share them 4 free . It will be shame Megaupload host to delete them. Thank you |

I wonder, when you state sell, does this specifically mean or include distribution licenses ? for instance as we know Psygnosis got eaten up by sony, NONE of thier software has a current distribution license (not saying they wont in future) where as ORIGIN whom got eat up by EA still have distribution licenses on a small fraction of their software, notably the WING COMMANDER initial 6 games ( kilrathi three game saga) prophecy, academy and privettier.. it difficult... and in truth its just to damn confusing.... linking to the unknown data is a bad move, but i fail to see what would be wrong in linking to a website. it would be like a link to a bittorrent site... but given the choice i would forgo the link for fear of these boards being taken down. anyways i best stop i dont wanna start a legal v ethical debate ... its really not worth it, LOL mods have too much work to do as it is. |

Zetr0, i've not the knowledge for a correct discrimination of what's legal to share. i just pointed, answering the question about legality, that copyrights stand longer, to various degrees depending on the country and international laws and accords, than our concept of the time for a software to become abandonware. as it is abandoned, it's kinda safe to share, that don't mean it's legal. ethics here are not the point. i say however that the software that is not currently under the restrictions stated in the faqs, i.e. software not currently sold or distributed or specifically not allowed to be distributed by current request of rights owner, (we have had exemples of that too in the recent months, and it is perfectly ok) it is safe to share until said owners ask for stop.
when we talk of abandonware, wich outlines are not at all clear and fixed, we approximate only. in regard of the the user' question, i would say that he has to check the titles he want to share for them to comply to the rules, and if they do he can surely link the site. the mods will check it then. EAB's rule as everybody should know by now, is that no link is allowed to software outside what's in the faqs. |

It would be a shame to loose such a resource that you offer, but alas there have been to many website closures and close-calls and obviously a lot of huff and puff about what is, what is`nt and leagal. unfortunately unless some one contacts the software house or publisher to have for a deffinate that these works belong to the public domain then they well respectively belong to whom over owns the rights for a period of 50 years (in the case of computer programs books have 75 years) thats a leagal deffinition, but it doesn`t encompas this if a company has works, this company falls to recievership or liquidation* then works will fall unto the public domain where not (a) If the licesne was transfered to another party before liquidation conclusion (b) Existing distrubtion licenese still exist by another party. when companys get bought, most if not all the time the rights to all works past and previous are also included in the sale. there is only one exception from this. if ANY time in WHOLE or PART that licensed works are placed within the public domain (by the licensor) that work is part of the public domain and cannot be taken out. the only way would be to have either written agreement by said publisher/softwarehouse that these works are considered abandoned and the wrights to said software exist in the public domain. so if anyone whats to help me wright one up for SONY let get them psygnosis games released... |
