Humm... Possible or easy is not the question I think. Going to court will cost much more than what you can buy on their site. If such situation really happens, a copy-paste from this thread is more than probable... (just replace the company name).
Hopefully, as far as we know from what we can read on the net, such things is not to consider with Hyperion as today.

Take them to court? Why? It would cost you multiples of the cost of anything they sell!
If it comes down to that, it's simple to rectify. Don't buy from them directly, go through one of their dealers.
Although looking at the links, it seems the downloads and payment are handled by Avangate so you would be secure.

Maybe you don't need to replace the company name.

Cinemaware in cooperation with Hyperion Entertainment are proud to announce the re-distribution of its classic Amiga 68K Cinemaware titles.
There's also this little issue about them including kickstart V1.3 on their CDs.
You might recall that Cloanto isn't too happy about that. It's clearly detailed in the first lawsuit and products were withdrawn.

thread has additional info

I'm merely posting this before everyone concludes that Cinemaware is the sole reason for all problems concerning DOC in particular. There could be more to this...
