Multi-Publisher Legal War Looms Over 3-D Patent
A patent infringement case for the patent, "Method and Apparatus for Spherical Planning," is now pending. The case could have enormous implications and could affect nearly every 3-D video game ever made.

that lawsuit is utter gibberish!
BUT. there are so many lawyers in the world that there isnt enough legit work for them to do.so they have to find whacked out gibberish hippyish lawsuits to file. eg fat americans suing mcdonalds for serving fatty food. people suing stores for tripping over THEIR OWN KIDS whilst shopping. etc. etc.

I'd doubt this would ever get off the ground though, there were 3D games before 1988-this seems just a ignorant,frivilous attempt at fishing for money. I doubt any of the softcos. mentioned would be shaking in fear about it.
