KGWHD - confusion

Hi there do the game packs on http://kg.whdownload.com/kgwhd/ actually have the games? from looking at one of the packs and inside the files it would seem so... There is no info to state either way.

It is mostly illegal, but noone cares (well I don't).

Since it does not make the Amiga ROMS available, noone seems to bother.

I have found this to be a very strange philosophy over the years. No one seems to mind copying the games which is in fact copyrighted material, but when someone downloads an image of say kickstart1.3 for WinUAE every man and his dog seems to jump up with anger calling them a pirate.

Strange, very strange....

Everything not covered by that rule is considered 'okay' to share (but it's still not legal).

Not that strange KevG - the Workbench ROMS are still sold today, and spreading them gets sites into trouble and reported.

Ancient games people turn a blind eye to, unless a thread like this pops up. It would be a pretty misrible place if eveyone enforced letter of the law at every opportunity.

Hi CyberDruid.

Yes, I read the quote. "It is illegal to distribute kickstart ROMs or Workbench disks (even if modified) as they are still copyrighted."

However, these rules are EAB rules. If EAB where to follow the letter of the law then the term "As they are still copyrighted material" would apply to commercial games as well. The only exceptions I could think of are games which were published by companies that no longer exist as they would be unable to persue copyright infringement cases.

I know that no one really gives a shit these days, but technically, I think that am right here.

lots of formerly commercial games are now free (Gremlin, Cinemaware, ...)
Since no profit is done with the old amiga games, no one will sue for their download (check PC abandonware sites, there are a ton of them and noone cares either)

Even Sega and Nintendo didn't care about it, e.g the SNES/Mega Drive roms. So, who else cares? I enjoy the old classics for sure.

Abandonware is just a fancy name, doesn't mean anything. Like jotd says, the main reason why some things can't be linked or uploaded here is because there are still people interested in selling those things and thus could take legal action against EAB. Anyway, I think it has been discussed enough in this thread and in the past, so this one gets closed now.
