All that "good money" Eclipse thinks could be made wouldn't even cover your lawyers first consultation

There is nothing illegal in making your own kickstart, the problem comes if you don't alter it enough and sell it. I'm pretty sure becuase of it's age all 4 factors of the fair use doctrine would come into effect.
A-Inc certainly do not frighten me and I most certainly would not need a lawyer.
This has been discussed to death and this is not the thread to carry it on.

So the point is: you can burn your own version of kickstart, provided you have the (physical) original one and pay the right to own the upgrade.

I simply don't want to go that route simply because of this.

But it is dead easy to make your own kickstart chip(s) if you want to and have the necessary hardware (EPROM burner and files).

Tailor-made ROMs are difficult to make. It is a "make a few of that", other few of another.

Not good for mass-production. And Haage-Partner is the owner of 3.9 ROM, not Amiga.inc . They will not agree with each other.
