no, i think os3.9 patches the ROM to 3.9.... it is only in software though.
Could be wrong though |

SETPATCH updates certain things in the ROM (no, it doesn't put them back into the ROM, it puts them in memory) and this results in the 3.9 insert disk screen. You just need to run SETPATCH (OS3.9 version) and have no bootable drives to get this. I see it from time to time with my A4000/Kickflash OS4 combo (ie. when prepping a new drive, etc.).
