I don't think there is anything to worry about.

1) Patents are good for 20 years in the U.S. All 68k patents should be expired.
2) An ISA and ABI seem to be tricky to patent.
3) Freescale had no problem with the Natami team making an FPGA 68k CPU when contacted
4) Freescale/NXP has had no problems with InnovASIC's CPU32 Fido ASIC
