Joking aside, all experience from OS4 says that Hyperion releases fixes when it fits them, not when the fixes are ready or when developers are ready.

The big problem with this bug, is exactly that it is so subtle.

I know one bug that is similarly dangerous, the max transfer bug. But it only affects certain...

None of the bugs you mentioned were potentially dangerous, as in the system appearing to work normally, but "randomly" doing things it should not do.

If you think Cloanto are distributing anything illegally, then please contact the right authorities. As far as I know, they always distributed Amiga OS legally.

No, and that was not what I said. Cloanto asked respective patch authers for permission.

Many popular/common patches are specifically not in OS 3.X bexause the authors did not permit it.

Yes it does. Would it make any difference if Cloanto offered patches separately to original binaries, and used an installer script to apply them? That would be a rather semantical difference.

But yes, it's rather beside the point, Cloanto had license to sell original 3.1 and authors of patches allowed Cloanto to use them. Most of all, the 3.X kickstarts...
